Constructive Eviction
Constructive Eviction occurs when a landlord does not actually initiate the eviction process, but instead interferes with a tenant's ability to use and enjoyment of the premises to the extent to constitute "eviction in fact" meaning they essentially are not able to use the property according to the agreement's terms.
