Escape Clause
A clause in an agreement that allows at least one party to terminate the agreement without penalty. In some cases, this may also be referred to as a "kick out" clause. For example, if a buyer has a home-sale contingency in an agreement to purchase, a kick-out clause may allow the seller to move ahead with another buyer after giving the original buyer first right to remove their contingency and fully commit.
